Mr. James Robert Belcher

Mr. Belcher is a partner in Schultz & Belcher LLP, which he and Don Schultz formed in 2008 after their 20+ year tenure in a large regional law firm. In his practice, Mr. Belcher drafts and evaluates construction contracts and, with Don Schultz, litigates commercial construction disputes and disputes arising from oil and gas operations. Mr. Belcher has extensive experience in resolving mechanics’ and oil and gas lien claims.

Mr. Belcher also practices in all areas of financial and corporate business matters, together with his creditor bankruptcy practice. Mr. Belcher has assisted clients with energy development and transmission, including wind energy projects, natural gas gathering and pipelines, and electrical transmission. This includes project development and finance, mineral developer-surface owner disputes, right-of-way acquisitions and condemnation and other related advice. Prior to attending law school, Mr. Belcher was a commercial banker for 13 years, last serving as the senior lender in a bank holding company affiliate bank. Mr. Belcher utilizes his broad knowledge of banking, financial transactions, and secured creditor experience, in his representation of clients. In his financial and corporate practice, Mr. Belcher has assisted both borrowers and lenders with UCC, real estate, mortgage, consumer credit and loan documentation of all kinds, and has extensive experience in issuing opinions for business and secured transactions.

Mr. Belcher works with corporations, partnerships, limited partnerships and limited liability companies in formation, merger, continuance into Wyoming, and transfer out of Wyoming to another jurisdiction. In his bankruptcy practice, Mr. Belcher primarily represents creditors. However, he has extensive experience in representing trustees and creditor committees in Chapter 7, 11, and 13 cases. His practice ranges from simple stay relief motions for financial clients to very sophisticated transactions and litigation, including the successful confirmation of creditor plans in Chapter 11 cases. He also has broad experience in prosecuting and defending fraudulent conveyance and preference actions.

During his law school education, Mr. Belcher authored several Law Review articles relating to letters of credit and the operation of the newly enacted Chapter 12 bankruptcy in its initial stages. After beginning his law practice, Mr. Belcher edited the only book on Wyoming mortgage law, The Wyoming Law of Mortgages, authored by George Rudolph, who was Wyoming’s most notable mortgage scholar. Recently, Mr. Belcher authored an article “Nonconsensual Liens Under Title 29,” published in the June 2008 edition of the Wyoming Lawyer. He and Don Schultz are authors of the ABA State-by-State Guide to Construction and Design Law (2008 Second Edition), Wyoming Chapter.
