The Wyoming Supreme Court adopted a Rule of Professional Conduct 1.15A regarding retention of client files, which is the subject of frequent Ethics Hotline calls. With attorneys leaving the practice at an ever-increasing rate (e.g., with the “Silver Tsunami” attributable to Baby Boomers reaching retirement age), there are numerous benefits associated with a rule dedicated to this issue. The rule is modeled after a Massachusetts rule, and underwent significant revisions based upon comments from Bar members as well as lengthy discussion among members of the Board of Professional Responsibility and the Bar Counsel Review and Oversight Committee.
